Even though the applicants were the first to extract and exploit IP-PA1, it did not necessarily follow that they should obtain trademark protection over the term.

The decision shows that similarity between the marks, users and trade channels does not necessarily lead to a likelihood of consumer confusion if there is no competition between the goods/services.
