General Court narrows chances to submit evidence to OHIM

In upholding the revocation of a trademark on the grounds of non-use, the General Court recently held that supporting evidence produced by the applicant in the administrative proceedings, taken as a whole, was clearly insufficient for the purposes of establishing genuine use of the mark at issue.

Court order creates an online search results conundrum for Uber

The United States District Court Northern District of Florida has ordered Uber Technologies to ensure that specific search engine results in Alachua County do not replace the results for local company Uber Promotions. The ruling potentially places Uber Technologies in a tricky situation, as it seeks to ensure that results across multiple search engines comply with the order.

Trademarks for shape of London taxis found invalid and not infringed

In a recent decision Justice Arnold found that a Community trademark and UK trademark based on the shape of the Fairway model of London taxi would be perceived by the average consumer of taxis as a variation in the typical shape of a taxi and therefore lacked distinctive character.

General Court leaves no stone unturned

The General Court of the European Union has dismissed an appeal against a previous decision of the OHIM Second Board of Appeal and confirmed that the figurative mark AEROSTONE and the word mark STONE were similar, and that there was a likelihood of confusion between the marks.

Baby, you can drive my '.car' (for $3,000)

Three new gTLDs focused on the automobile industry - ‘.car’, ‘.cars’ and ‘.auto’ - have been launched, with the sunrise period running from December 9 2015 to January 12 2016. These gTLDs are being marketed at automobile manufacturers and car dealers, rather than the general public, but the high registry fees (starting at $3,000) could deter potential registrants.

User principle confirmed for assessing damages in passing-off cases

In <I>Winnebago Industries Inc v Knott Investments Pty Ltd (No 4)</I>, the Federal Court has handed down its decision regarding damages in the long-running dispute between Winnebago Industries Inc and Knott Investments Pty Ltd over the use of the WINNEBAGO marks. This case confirms that the user principle applies to the assessment of damages in Australian passing-off cases.

Genoa court clarifies ECJ Montex decision in patent case

In a case involving patents, a court in Genoa has given useful guidance on the interpretation of the European Court of Justice decision in Montex Holdings Ltd v Diesel SpA. Among other things, the Genoa court decision clarifies that the actual destination of goods for the purposes of a preliminary seizure and injunction can be demonstrated by means of documentary evidence, such as the relevant shipping documentation.
